2. DESCRIPTION OF ACTIVITIES
Fierce N Fit Special Needs Charitable Organization provides boxing instruction, fitness training, strength and conditioning programs, group classes, pad work, bag work, drills, community outings, demonstrations, and related athletic and recreational programming (collectively referred to as the “Activities”).
Activities may occur at gym facilities, rented spaces, community venues, outdoor locations, or organized events.
3. ACKNOWLEDGEMENT OF INHERENT RISKS
Participation in boxing and fitness activities involves significant inherent risks, including but not limited to:
• Physical contact with equipment or other participants
• Being struck by gloves, pads, bags, or training implements
• Slipping, falling, or collision
• Sprains, strains, fractures, and dislocations
• Head injury, concussion, or traumatic brain injury
• Dizziness, fainting, cardiac events, or overexertion
• Aggravation of pre-existing conditions
• Emotional or behavioural triggers
• Equipment malfunction
• Negligence of other participants
4. ASSUMPTION OF RISK
Participation is voluntary.
The undersigned fully understands and voluntarily accepts and assumes all risks, dangers, and hazards associated with participation in the Activities, including risks arising from the negligence of Fierce N Fit Special Needs Charitable Organization and its directors, officers, employees, volunteers, contractors, instructors, agents, representatives, sponsors, facility operators, and affiliates (collectively referred to as the “Released Parties”).
5. RELEASE OF LIABILITY
In consideration for being permitted to participate, the undersigned releases, waives, and discharges the Released Parties from any and all claims, demands, actions, damages, losses, or expenses of any kind arising out of or related to participation in the Activities, including but not limited to claims arising from negligence, breach of duty of care, or any other legal theory.
This release applies to personal injury, death, property damage, or any other loss.
6. INDEMNIFICATION
The undersigned agrees to indemnify and hold harmless the Released Parties from any and all claims, demands, damages, liabilities, costs, or expenses, including legal fees, arising out of the participant’s involvement in the Activities or any claim brought on their behalf.
7. MEDICAL CONSENT
The undersigned confirms that the participant is physically and medically able to participate in the Activities.
The undersigned authorizes Fierce N Fit to obtain emergency medical treatment for the participant if deemed necessary. All medical costs are the responsibility of the participant or guardian.
Fierce N Fit staff and volunteers are not medical professionals and are not responsible for medical diagnosis or treatment.
8. SPECIAL NEEDS DISCLOSURE AND SUPERVISION
The undersigned agrees to disclose all relevant medical, behavioural, cognitive, and physical conditions that may affect safe participation.
While reasonable supervision is provided, Fierce N Fit cannot guarantee constant one-to-one supervision unless specifically agreed to in writing.
Failure to disclose relevant information may increase risk.
9. PROGRAM PARTICIPATION REQUIREMENTS
As a condition of enrollment, the undersigned acknowledges and agrees to the following:
The participant is able to independently manage activities of daily living and basic self care unless specific written support arrangements have been made in advance with Fierce N Fit.
Fierce N Fit is not responsible for participants who leave the premises or program space without authorization or supervision.
Participants must be dropped off and picked up promptly at scheduled program start and end times. Fierce N Fit does not provide before or after program supervision unless specifically agreed to in writing.
Fierce N Fit maintains a zero tolerance policy for bullying, harassment, or unsafe behaviour. Participants who engage in such behaviour may be removed from programming.
An updated Physical Activity Readiness Questionnaire Par Q or equivalent health disclosure form must be completed prior to participation and updated as required.
The undersigned understands that failure to comply with these participation requirements may result in suspension or removal from programming without refund.
10. TRANSPORTATION AND OFF-SITE ACTIVITIES
If participation includes transportation arranged by Fierce N Fit, including volunteer drivers, rideshare services, taxis, or third-party transportation providers, transportation carries inherent risks.
The undersigned releases the Released Parties from any liability arising from transportation or participation in off-site activities.
11. MEDIA CONSENT
The undersigned grants permission for Fierce N Fit to photograph or record the participant during Activities and to use such media for promotional, educational, or charitable purposes without compensation.
12. RULES AND CONDUCT
The participant agrees to follow all safety rules, instructions, and codes of conduct.
Unsafe conduct or refusal to follow safety instructions may result in removal from programming.
13. SEVERABILITY
If any portion of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
14. GOVERNING LAW
This agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
